Terms & Conditions of Sale

BASIS OF CONTRACT

Any order accepted by the seller will be subject to the sellers terms and conditions of sale and no other conditions shall apply unless expressly agreed in writing.

PRICES

The quoted prices are deemed to be in all cases current at the time of quoting and nett exclusive of VAT. Value Added Tax will be chargeable on all goods sold. The prices invoiced will be those currently charged by the seller at the date of despatch. All online prices are quoted as collected prices – with transport being an additional cost.

DELIVERY

The seller shall not be held liable for any losses incurred by the buyer or any other person as a result of any delay in the delivery of goods sold. Please see (link for delivery & returns policy here) for further details

TERMS OF PAYMENT / RIGHT OF TITLE OF GOODS

Non-credit-account customers can only pay for products purchased through our website by debit or credit card. We will take payment for your order, including VAT and delivery, from your debit or credit card at the time you place your order. However this does not mean that your order has been accepted. If we reject your order for any reason, or we can’t supply the products you have ordered, then we will credit your payment in full to the card originally charged.

Your order will not be automatically accepted until we dispatch your goods. Before we accept your order we reserve the right to tell you that your order has been cancelled for any reason. In particular all orders are subject to stock availability. We will advise you as soon as possible if we cannot supply one or more of the products you have ordered. If we cannot contact you, we reserve the right to supply the selective products we do hold in stock.

Without affecting your Consumer Cancellation Right, you can cancel your order for a product at no cost, providing the cancellation is received during office opening times, before your goods are dispatched. However if your order incorporates any special made to order items, this right to cancel does NOT apply.

For credit accounts standard terms are nett cash monthly – payment to be made by the last day of the month following the month of delivery – “the due date”. Interest will be paid on a daily basis at the rate of 4% above Royal Bank of Scotland base rate. This will apply on any balance outstanding from the due date, until payment.

Title to the goods remains with the seller until full payment has been received by the seller, and the goods have been dispatched. Nevertheless the risk in the goods passes to the customer on delivery.

DISCREPANCIES AND DAMAGED GOODS

No claim for discrepancy or damaged goods will be considered unless our office has been informed of the claim within 24 hours of the customer having taken delivery of the goods. This notification may be verbal – but must also be followed up with a written report received within 24 hours also.

LIABILITY

Our liability for goods proven defected is confined to replacement only of the defective goods. All other liability for every form of accident, loss or profit, consequential loss or damage – is expressly excluded.

DAMAGE TO PAVEMENTS, DRAINS AND OTHER PROPERTY

The vehicles used for delivery shall be suitable for travel on hard roads which carry normal heavy rubber tyred vehicles. If the customer requests that the vehicle leaves the road surface to travel over pavements, driveways, open sites, etc in order to access an off-loading area, the buyer will be held completely responsible for any and all damage caused as a result. This covers damage to any flat surface, vertical surface, landscaping, drainage or property, as well as to the vehicle itself.
